- Terms & Conditions for Eco-Friendly Merchandise Orders

1. Introduction
These Terms and Conditions (“Terms”) govern all merchandise orders placed with [Jika Productions Pty Ltd] (“the Company”). By submitting an order or accepting a quote, the client (“Client”) agrees to be bound by these Terms, which are governed by the laws of the Republic of South Africa.
2. Nature of Goods
2.1 The Company offers a curated range of eco-conscious merchandise, which includes both:
– Locally produced, handmade items crafted by small community suppliers, and
– Internationally sourced, sustainably manufactured products selected for quality and environmental responsibility.
2.2 Due to the nature of our diverse supplier base:
– Handmade items may take longer to produce, may have limited capacity for high-volume orders, and may display natural variation in colour, size, finish, or branding due to artisanal processes.
– Internationally sourced items are typically more uniform, faster to brand, and more scalable for large orders—but may be subject to customs or shipping-related delays.
2.3 The Client acknowledges that product timelines and final appearance may vary depending on the source and nature of the item selected.
3. Branding and Customisation
3.1 Branding options (e.g. screen printing, embroidery, engraving) are subject to the material and design of each item.
3.2 If a product requires branding:
– The Company will advise on the most suitable branding method for that item.
– Some branding may impact delivery timelines and/or incur additional cost.
– The Client acknowledges that branding placement and outcome may vary depending on the surface or medium.
3.3 Requests for physical branded mock-ups must be made in writing, and:
– Will incur a separate fee, quoted based on scope.
– Must be factored into timelines in advance.
– Are subject to supplier availability.
4. Order Process & Approval
4.1 Orders are only deemed accepted once a formal quote is approved and full upfront payment is received.
4.2 Upon submission of a product cart or order request, the Company will:
– Review the feasibility of production across suppliers.
– Issue a quote based on quantities, branding, lead times, and logistics.
4.3 Final approval of all designs, artwork, and specifications must be received in writing before production begins.
5. Payment Terms
5.1 Full payment is required upfront to secure production. This ensures supplier commitments and community-based manufacturing.
5.2 Due to the nature of custom and handmade products, no refunds or returns will be accepted once an order is confirmed and payment is made, unless due to proven defect or error on the part of the Company.
5.3 Quotes are valid for 7 (seven) calendar days unless otherwise stated. Pricing may fluctuate due to exchange rates, supplier pricing changes, or order quantity adjustments.
6. Delivery & Timelines
6.1 Estimated delivery times will be shared on quotation and may vary based on:
– Product origin (locally handmade vs. internationally sourced)
– Quantity
– Customisation requirements
– Availability of materials
6.2 While every effort is made to honour delivery estimates, timelines are indicative and subject to change due to external factors beyond the Company’s control (e.g., supplier delays, customs, transport disruptions).
6.3 The Company will not be liable for any indirect or consequential loss due to delivery delays.
7. Cancellations & Amendments
7.1 Once production has commenced, orders cannot be cancelled or amended.
7.2 In cases where amendments are possible before production begins, a revised quote will be issued, and the Client will be responsible for any cost increases.
8. Return and Refund Process
8.1 Return Process: If your order qualifies for a return, please contact us at emily@jikaproductions.co.za with your order details and a description of the issue.
8.2 Refunds: If approved, refunds will be processed within 7–10 business days.
9. Intellectual Property
9.1 All artwork, logos, or brand assets supplied by the Client are assumed to be their property or used with permission. The Client indemnifies the Company against any third-party intellectual property claims.
10. Limitation of Liability
10.1 The Company will not be held liable for:
– Minor product variations due to handmade nature
– Delays arising from third-party suppliers
– Any damages arising from improper use or handling of the product by the Client or their recipients
11. Force Majeure
The Company shall not be liable for failure to fulfil its obligations if such failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, supplier failure, transport disruptions, or pandemics.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be handled in the appropriate courts of the Western Cape, unless otherwise agreed in writing.
12. Acceptance of Terms
By confirming a quote, placing an order, or paying an invoice, the Client confirms that they have read, understood, and accepted these Terms.
